*Standard EBMS Hours are 8:00am to 5:00pm EST Monday through Friday except for holidays. The business day preceding holidays may be shortened. All Saturday and Sunday calls are considered after hours. ($200/hr. 1hr minimum)
Software Assurance (a feature of all EBMS Subscription plans) not only covers the EBMS program, but also all customizations created by Eagle Business Software. This Software Assurance ensures that EBMS and customizations will work as designed. If newer versions of EBMS include design changes which cause a customization to no longer be compatible, we will ask our client to fund the change to update the customization to work with the newer EBMS version.
Note: Discontinuing Support & Upgrade Subscription
At the time a client discontinues the support and upgrade subscription, the user forfeits the right to access updated forms, tax tables, reports, software updates, and other support and update options. Replacement installation discs and all other support services are fully billable. An EBMS software upgrade must be purchased before a user may re-subscribe to the support & upgrade subscription. The upgrade purchase price will be the greater of 50% of EBMS Value and the amount that would have been paid if the Silver Subscription had been continuous. However, if, within a six-month grace period subscription is resumed, only the amount of the Silver Subscription that would have been paid in the interim will be billed. Subscription plan users may switch plans at no additional cost.

In no event shall Eagle/ECC be liable for costs of procurement of substitute products, loss of profits, data, or use of the software product, or special, incidental, or consequential damages or other similar claims, however caused, and on any theory of liability, even if Eagle/ECC has been specifically advised of the possibility of such damages. In no event will Eagle/ECC be liable for any damages to you or any other person that exceed the lower of the suggested list price or the actual purchase price paid for the software product, regardless of the form of the claim. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy. All third party suppliers to Eagle/ECC of any portion of the software product make no warranty and shall have no liability to you.

Eagle Business Software recognizes the importance of budgeting for software implementation, staff training, consulting etc. and offers Prepaid Support Packages at a discounted rate. Prepaid Support Packages are available in prepaid time blocks of 10, 20, 50, and 100 units.
